Union noticeboard space is legally approved to be at your workplace

Did you know that the IEU has the legal right to noticeboard space at most of your workplaces and that right extends to Reps who also have the legal right to add union communications to this space?

And did you know that employers have NO RIGHT to remove any union communications from the IEU noticeboard space?

The union noticeboard is an important space for the IEU to share upcoming information, events, enterprise bargaining updates, membership benefits, new member join information and much more.

As of 1 July 2024, legislation for Workplace delegates’ rights (delegates/representatives – same role) was passed and all Enterprise Agreements (EAs) must include a clause in their next EA that states these legal rights accurately.

For example, FairWork Australia notes that delegates (Reps) are entitled to:

  • reasonable communication with members and potential members about their industrial interests
  • reasonable access to the workplace and facilities to represent those interests
  • reasonable access to paid time (during normal working hours) for training related to their role as a delegate (unless the employer is a small business employer).

So where should the union noticeboard be?

The IEU noticeboard should be in a common area that members agree will be seen regularly by ALL staff members at the workplace.

Employers must not:

  • unreasonably fail or refuse to deal with delegates
  • knowingly or recklessly make false or misleading statements to delegates
  • unreasonably hinder, obstruct or prevent delegates from exercising their rights under the Fair Work Act or a fair work instrument.

Where can you get IEU(SA) communications for your noticeboard?

Your IEU(SA) Rep can obtain workplace noticeboard materials with the support of your workplace Organiser from the IEU(SA) office.

What if employers pull union notices from IEU(SA) noticeboard space?

If your employer is removing IEU communications from your worksite noticeboard, contact the IEU urgently – 8410 0122 or enquiries@ieusa.org.au
